These Terms of Service ("Terms") govern your use of WhichSpot ("WhichSpot", "we", "us"). By using the service you agree to these Terms. If you do not agree, do not use WhichSpot.
Not an emergency service
WhichSpot is not an emergency service and is not a substitute for 911 or professional help. In a life-threatening situation, call 911 or your local emergency number first. The emergency and incident features are tools to help you find help and keep your own records. We do not monitor incident reports, dispatch responders, or guarantee that any location, phone number, or distance shown is accurate or available.
What WhichSpot does
WhichSpot shows a live map of places and conditions and lets you document incidents. Information about places, busyness, cameras, fuel prices, and nearby services is gathered from third parties and from public data, and may be incomplete, delayed, or wrong. Use your own judgment.
Your account
You are responsible for keeping your account secure and for activity under it. You must provide accurate information and be old enough to form a binding contract in your jurisdiction.
Your content
You keep ownership of the incident records, photos, video, and text you create ("Your Content"). You grant us a limited license to store, process, and display Your Content back to you so the service can work. We do not claim ownership of Your Content and we do not share it except as described in our Privacy Policy. You are responsible for Your Content and for having the right to capture and store it.
Acceptable use
- Do not break the law or use WhichSpot to harm, harass, or endanger anyone.
- Do not upload content you do not have the right to share.
- Do not interfere with, scrape at scale, overload, or attempt to bypass the security of the service.
- Do not misrepresent who you are or impersonate others.
- Do not post objectionable content: nothing abusive, hateful, harassing, sexually explicit, or otherwise offensive.
Objectionable content and moderation
There is zero tolerance for objectionable content or abusive users. Any content you contribute (including place submissions, ratings, and reports) can be reported from within the app using the Report control. You can also block another user so you no longer see their contributions. We review reports and remove violating content and offending accounts, typically within 24 hours. We may remove content or suspend accounts that violate these Terms at our discretion.
Deleting your account
You can permanently delete your account and associated data at any time from My Account → Delete my account in the app. This removes your private content and de-identifies anything shared with the community. Deletion is permanent and cannot be undone.
Evidence disclaimer
Incident records you create are your own documentation. We do not certify, authenticate, or guarantee the admissibility of any record for insurance, legal, or any other purpose. Whether a record is accepted by an insurer, court, or authority is outside our control.
Service availability
We may change, suspend, or discontinue any part of WhichSpot at any time. We aim for reliability but do not promise the service will always be available or error-free.
Disclaimers
WhichSpot is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and accuracy of information.
Limitation of liability
To the fullest extent permitted by law, WhichSpot and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on information shown in the app or from the availability or accuracy of any place, service, or incident record.
Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the date at the top of this page. Your continued use of WhichSpot after a change means you accept the updated Terms.
